Patenting the idea

You can protect your idea by registering a Provisional Patent.

Provisional Patent will protect your idea from replicating for a temporary period of 12 months.

Within the period of 12 months, you need to complete your invention and then you need to proceed for Patent Registration (permanent).

If you failed to complete your invention within 12 months from the date of filing Provisional Patent, then your idea will not be further protected by authority.

Here are the steps for Provisional Patents:

Step 1: Patent Search - Before doing provisional patent, you need to do the Patent Search to check whether the same type of idea has been invented/patented or not.

Patent Search

Step 2: Patent Drafting - If your patent is unique, then you need to proceed for Patent Drafting. Patent Agent is the authorized person for doing Patent Drafting.

Step 3: Provisional Patent Filing - Further, you need to proceed for Provisional Patent Filing.
Patent Agents will help you in the Patent Registration process. After the successful provisional patent registration, you will get the time period of 12 months to complete your invention.

Patent Registration

In this period of 12 months, your patent will be protected from copying.

Step 4: Period for completion of invention - You need to complete your invention and then you need to reapply for Permanent Patent Registration.

Step 5: Permanent Patent Registration - Patent Agent will re-apply for the Patent Registration in this stage.

Step 6: Publication - After Patent Registration, your patent will be published in the Journal.

Step 7: Patent Examination / Objection - Authorized organizations, will check the Patent and will raise the objection on it.

Step 8. Patent Granted - Then, you need to reply to the objections. After clearance, the patent will be granted for the invention.

This is the complete process for Provisional Patent Registration.
