Pre 18-month publication

Hi,

I would like to find out the percentage of applicants that request the USPTO an early publication (namely, before the 18-month rule compels publication).

Is there a report of the USPTO regarding that matter? If not, any idea of how can I get this data from the datasets?

I don't think there is anything to indicate early publication in the bulk grant xml files that the patentsview database is built from.  I don't think you can use the api to determine this.

I'm not a patent librarian but I am on their listserv  (it's a long story).  I repeated your question there to see if there is another source.  One of the librarians is checking with contacts of his.  I'll either proxy the reply or see if he'll register as a user here and reply himself.  He did suggest using the uspto's appft on a particular publication date, the most recent one being December 3, 2020.   pd/12/3/2020 shows that 8162 applications were published.  You could also query to see the ones that were published then and have a filing date less than 18 months before that.  pd/12/3/2020 and apd/7/1/2019->12/3/2020 finds 4926 matches.  I'm not sure if that really indicates a request to publish early and you wouldn't know which applications published then will become granted patents.   I'm hoping there will be a better alternative.

I did hear back from my patent librarian friend.  He said that the uspto does not have statistics on how many requests they get for early publication.
